How inheritance tax works in British Virgin Islands

The BVI does not impose a standalone inheritance tax, estate tax, succession tax or general gift tax. The BVI Business Companies Act also provides that no estate, inheritance, succession or gift tax is payable on shares, debt obligations or other securities of a BVI company.

That is a tax result, not a succession result. A BVI will, foreign will, probate application, resealing process, shareholder register, company articles and the location of real estate can all affect how quickly assets pass to heirs.

Transfers of BVI land and interests in land-owning companies can still create stamp-duty exposure. An heir's country of residence or the country where inherited assets are located can also charge estate, inheritance, gift or capital-gains tax.

Watch out for

  • No BVI inheritance tax does not mean that an estate can skip probate, court filings, land-registration steps or corporate transfer formalities.
  • BVI land and shares in land-owning companies are the main local transfer-tax concern. The BVI's ordinary company-share exemptions do not remove the land-related stamp-duty exception.
  • Heirs who live in a country with inheritance, estate or gift tax may owe tax there even when the BVI charges nothing. The same applies to inherited property or investments located outside the BVI.
